IRS seizure is the last-resort tool.

Seizure of real estate or business assets is the IRS's last-resort collection tool. By the time seizure is imminent, the situation has usually been developing for years. We can often halt seizure through emergency filings — but only with immediate action.

In short

IRS seizure is the actual taking of physical property (real estate, vehicles, business equipment) to satisfy unpaid taxes. It's rare — the IRS prefers liens and levies — and almost never happens without warning. Stopping a seizure requires emergency intervention: usually a Collection Due Process appeal, an installment agreement proposal, or proof of pending OIC review.

Seizure of a primary residence

Seizure of a primary residence requires court approval and is rare — but possible. The IRS must show that the taxpayer has substantial equity and has refused all other resolution paths. We can typically negotiate any alternative path (even a marginal one) faster than the IRS can complete court-approved seizure.

Seizure of business assets

Business equipment, inventory, and accounts receivable are easier IRS targets than residences. For active businesses, seizure of operating equipment ends the business — which the IRS sometimes uses as pressure. Emergency installment agreements or OIC submission often pause seizure proceedings.

Collection Due Process appeals

When the IRS issues a Final Notice of Intent to Levy/Seize, you have 30 days to request a Collection Due Process (CDP) hearing. The CDP hearing pauses collection action and lets us negotiate with IRS Appeals — often achieving a better outcome than direct negotiation with the collection officer.
